The rental benchmark index in Catalonia: what it is and how it affects you

The rental market in Catalonia has been undergoing one of its most significant regulatory transformations since 2023. The Consumer Price Index (CPI) is no longer the benchmark for rent increases; new indices have emerged with names that are not always easy to distinguish, and the rules vary depending on the type of landlord, the contract date, and whether the property is located in a high-demand area.

01 · The IRAV: the new index for updating rents

From January 1, 2025, the Housing Rental Reference Index (IRAV) is the official index for annually updating rents for standard residential rental contracts. It is published monthly by the National Institute of Statistics (INE) and replaces the Consumer Price Index (CPI) as the adjustment threshold.

 

  • Which contracts does it apply to? This applies to all standard residential rental agreements signed from May 26, 2023 onwards, the date on which Law 12/2023 on Housing came into effect. Previous agreements continue to be governed by their original terms (usually the CPI or another agreed index).
  • How is it calculated? The IRAV is the lowest value among three indicators: the year-on-year change in the CPI, the change in the core CPI, and an average rate adjusted with technical coefficients (alpha = 0.5 and beta = 2%). The objective is for the increase to always be less than or equal to actual inflation, avoiding disproportionate increases.
  • What is the current value? The IRAV for April 2026 is 2.4%. For comparison: December 2025 closed at 2.32%, and during 2025 it remained consistently between 1.99% and 2.32%.
  • When does the update take effect? Once a year, coinciding with the date the contract is signed. The landlord must notify the tenant at least one month in advance.

 

Practical example

The contract was signed in May 2024 with a rent of €1,200/month. In May 2026, the landlord can apply the IRAV (Real Estate Tax) for the corresponding month. With an IRAV of 2.41% of the 3-month period: €1,200 × 2.41% = €28.80 increase. New rent: €1,228.80/month. The landlord must notify the landlord in writing at least one month in advance and attach the index published by the INE (National Institute of Statistics).

 

02 · SERPAVI: price limit for new contracts in stressed areas

The IRAV regulates the annual updating of existing contracts. But when a new contract is signed in an area declared to be a stressed residential market, a second instrument comes into play: the State System of Reference Prices for Housing Rentals (SERPAVI).

 

SERPAVI sets a reference price by zone, type, and size of property. Its application varies depending on the type of owner:

 

  • Small landlord (less than 10 properties, or less than 5 in a stressed area): The new contract cannot exceed the rent of the previous contract in effect for the last 5 years, updated using the IRAV (Real Estate Housing Index). If there was no previous contract, the SERPAVI (Regional Housing Service) serves as a guideline, not a mandatory one.
  • Large fork in a stressed area: The new contract must respect the SERPAVI limit or the rent of the previous contract, whichever is lower. This is a requirement, not a suggestion.

 

Attention property owners in Catalonia

In Catalonia, the definition of a large property owner in high-demand areas is more restrictive than the national one: owning five or more properties in the same high-demand area (compared to ten in the rest of Spain) is enough to be subject to the mandatory SERPAVI limits. If you own several properties in Barcelona or municipalities in the metropolitan area, check if you meet this threshold.

 

03 · The index of the Agència de l'Habitatge de Catalunya: context

It's worth noting that the Catalan Housing Agency (Agència de l'Habitatge de Catalunya) has had its own reference price index for rentals since 2020. However, since the implementation of the "stressed areas" designation in March 2024, the legally applicable index for setting the price of new contracts is the national SERPAVI index, not the Agency's own index.

 

The Catalan government has repeatedly demanded that the Ministry of Housing recognize its index as the official reference in Catalonia, considering it more restrictive and more aligned with market realities. The Ministry has maintained that SERPAVI is the only legally applicable instrument under Law 12/2023. The Catalan Housing Agency's website remains active and can be consulted for informational purposes, but it has no independent binding effect.

 

In practice

The applicable index for setting the price of a new contract in a high-demand area is the state-run SERPAVI index. If you have any doubts about which price limit applies to your specific property, always consult a real estate or legal professional.

The practical rule is simple: the IRAV is used to update existing contracts; the SERPAVI and the Agència index are used to set the price of new contracts in high-demand areas. In Catalonia, the more restrictive limit of the latter two is always applied.

 

05 · Frequently Asked Questions

What happens to contracts signed before May 2023?

They are updated using the index agreed upon in the contract (usually the CPI) or, if there is no agreement, with the CPI. The IRAV does not apply to them unless both parties expressly agree to modify the reference index.

 

Can the landlord apply IRAV even if the contract states CPI?

No. If the contract signed before May 26, 2023, specifies the Consumer Price Index (CPI) as the adjustment index, that index prevails. The IRAV (Real Estate Adjustment Rate) is the legal limit for new contracts; it does not require modifications to existing ones.

 

What happened to the March-April 2026 2% cap?

Between March 22 and April 28, 2026, the Government applied a temporary cap on the 2% (Tax on Real Estate Transfers) adjustments to rent increases through Royal Decree-Law 8/2026. Congress rejected its ratification on April 28. Adjustments applied to the 2% during that period are valid and remain in effect; from April 29, the IRAV (Tax on Real Estate Transfers) will again apply.

 

Does IRAV apply to seasonal or room rental contracts?

No. Seasonal, tourist, and room rental contracts are excluded from the scope of IRAV. It also does not apply to commercial premises, offices, garages, or storage units.
